ASSUMPTION OF RISK, WAIVER OF LIABILITY, & INDEMNIFICATION*

By signing below, you acknowledge and agree to the following. Participation at the above event and use of the Company’s equipment and/or space assumes the risk of serious personal injury and illness. Injuries or Illnesses may range in severity from temporary injuries/illnesses to major catastrophic injuries/illnesses or even death.

ASSUMPTION OF RISK. All Participants knowingly and freely assume all risks, both known and unknown, even if such risk or injury arises from the negligence of the Company or others, and the Participants assume full responsibility and liability for any all injuries, illnesses, or damages resulting from their participation in all activities and use of the event space and equipment.

RELEASE AND HOLD HARMLESS. All Participants release and hold harmless the Company from and against any damages, liabilities, claims, demands, or losses from all injuries, illnesses, disability, death, or loss or damages to person or property related to the Activities of the Company, whether arising from the negligence of the Company (including any and all negligence in any rescue operation) or otherwise, to the full extent permitted by law.

INDEMNIFICATION. All Participants hereby indemnify the Company from any and all liabilities, claims, demands, losses, or damages related to Participant(s)’ activities with the Company in any manner, even if such liability arose due to the negligence of the Company (including negligence in any rescue operations), to the full extent permitted by law. This applies to any claims made by the Participants or on behalf of the Participants. This indemnification includes but is not limited to all expenses, attorneys’ fees, loss liabilities, damages, or costs the Company incurs as a result of any such claim(s).

DEFINITIONS. Company means BAK, LLC (formerly known as Rising Star Athletics LLC), dba Rising Star Athletics, and all of their employees, volunteers, owners, officers, managers, sponsoring agencies, sponsors, advertisers, other participants, owners, and lessors of the premises used to conduct any Activity or any other person associated with the Company in any manner. Participant(s) means the Child (or children) named above along with any other person associated with the Child that is participating in any of the Activities of the Company or using the event space and/or equipment. This includes but is not limited to the Child’s parents and legal guardians.

MEDICAL AUTHORIZATION*

The participant is responsible for all payments of expenses incurred relating to any Participants’ medical treatment, including emergency treatment and transportation services. Participant gives permission for any medical treatment necessary or recommended in the event of illness or injury at any event by the Company or any property of the Company of any minor child. The Participant authorizes all medical and surgical treatments, X-rays, laboratory, anesthesia, and other medical and/or hospital procedures as may be performed or prescribed by the attending physician and/or paramedics for the child and waive any right to informed consent of treatment. This waiver applies only in the event that the parent/guardian listed above cannot be reached in the case of an emergency. The Participant authorizes the emergency contact listed above to take the child from the care of the Company and to assume all responsibility and liability for the child, including all decisions concerning his or her medical treatment.
